My Home Foreclosure Defense Practice
I provide a broad range of legal services to individuals who face home foreclosure, including:
- Loan modification or restructuring - I will act as your advocate with your bank or mortgage company, working to negotiate new terms if possible, including reduced interest rates or an extension of the number of years on the mortgage. I will also seek to include any past due amounts in a new mortgage, so that arrearages are wiped out.
- Truth in Lending actions - If your lender failed to disclose required information during the mortgage process, I will take action to protect your interests.
- Personal bankruptcy filings - If I am unable to stop home foreclosure proceedings through any other means, I can advise you on the possible benefits of filing for bankruptcy protection. In a Chapter 7 bankruptcy, you can claim your principal residence as an exempt asset in certain circumstances, so that you don't have to sell it to satisfy creditors. With either a Chapter 13 or a Chapter 7 bankruptcy, an automatic stay goes into effect upon the filing of your petition, prohibiting your creditors from taking any further legal action until the bankruptcy is final.
